Homeowners and Construction Law

Florida Construction Law requires certain disclosure on some construction contracts. The contractor must disclose certain information intended to inform and protect homeowners. Some contractors may try to take advantage of homeowners, and some people do not have the proper license to perform the work they seek to perform on your home. Florida Construction Lien Law Disclosure

Florida law requires that the front page of many construction contracts provide a disclosure. Pursuant to Section 713.015, Florida Statutes, the contractor must provide disclosures about the dangers of making improper payments under the Florida Lien Law. So, if you receive a Notice to Owner regarding work on your home, be sure that you follow the lien law carefully before you make any payments to anyone. You may end up paying twice for the same work. The disclosure must contain the exact notice provision specified by law in bod print, 12 point type. That disclosure describes the rights of people to lien your property for improvements to your property. If you receive a Notice to Owner, be very careful about making any payments to anyone after your receive such a notice. 


Florida Homeowners’ Construction Recovery Fund Disclosure

Florida law also requires the disclosure of the Florida Homeowner’s Recovery Fund. Pursuant to Section 489.1425, Florida Statutes each contract for work on a residence must contain a specific disclosure contained in the statute. The notice informs the homeowner that Florida has a recovery fund which may provided help in recovering some losses up to $25,000.00. Construction LIens

If you receive notice that a construction lien has been recorded against your home or other property, I urge you to consider calling an attorney immediately. In some cases, a construction lien may be foreclosed and you may lose your home. Be sure you are prepared to handle that construction lien immediately. Normally, construction jobs do not involve a Claim of Lien. Someone recorded the Claim of Lien usually for non-payment. In fact, you may have never met the person filing the Claim of Lien. Even so, the law protects people who have improved your property, and were not paid in full for their improvements.   If you have received a Claim of Lien, be sure to seek legal advice immediately.
